Model Public Participation Guidelines Filing Instructions
Chapter 321 of the 2008 Acts of Assembly requires all agencies subject to §2.2-4007.02 of the APA to adopt model PPGs as developed by the Department of Planning and Budget or revised model PPGs based on the DPB model version to be effective no later than January 1, 2009. To help agencies prepare their PPGs in RIS, your agency's RIS project list has been automatically populated with (i) the model PPG language approved by DPB and (ii) a summary of the PPGs.
Preparing and Filing Regulations Using the Fast-Track Rulemaking Process
Chapter 224 of the 2003 Acts of Assembly added an exemption from certain provisions of the Administrative Process Act for agency regulations deemed by the Governor to be noncontroversial (see § 2.2-4012.1). To use this process, Governor's concurrence is required and advance notice must be provided to certain legislative committees.
Preparing and Filing Guidance Document Lists
Chapter 11 of the 1997 Acts of Assembly amended the Administrative Process Act and Virginia Register Act by adding the definition of a guidance document to both acts. The legislation requires each agency, on or before January 1, to annually file with the Registrar of Regulations a list of any guidance documents upon which the agency currently relies. These lists will be published in The Virginia Register of Regulations.

The Form, Style and Procedure Manual for Publication of Virginia Regulations
The Form, Style and Procedure Manual for Publication of Virginia Regulations (the Style Manual) contains guidelines for regulatory agencies preparing regulations for promulgation under the Administrative Process Act, Chapter 40 (§ 2.2-4000 et seq.) of Title 2.2 of the Code of Virginia. Designed to assist agencies in meeting their responsibilities, the manual establishes procedures for complying with The Virginia Register of Regulations' provisions of the Administrative Process Act. Guidance is also given regarding compliance with the Virginia Register Act (§ 2.2-4100 et seq. of the Code of Virginia) when the Attorney General's office determines that a regulation, regulatory action, or the agency itself is exempt from part or all of the Administrative Process Act. The manual is issued by the Virginia Code Commission under the authority of § 2.2-4104 of the Code of Virginia.
