
Each year during the General Assembly Session, the Joint Commission on Health Care introduces a legislative package which consists of several bills and resolutions. Many of these legislative proposals are the results of the studies conducted by the Joint Commission throughout the year.

Amend Code of Virginia Title 19.2, Chapter 11.1: (1) to replace

“the community services board or behavioral health authority as designated by the
Commissioner” and (2) to add (where omitted) “or behavioral health authority” wherever
“community services board” appears. (SB 1104 is a companion bill to HB 2369)
Insane defendants; restoration of competency
Senate Bill 1103

Amend Code of Virginia Title 19.2, Chapter 11 to recognize
the role of the CSB/BHA director (or director’s designee) in outpatient restorations
and to amend Code of Virginia § 19.2-169.3 to add “or his designee” wherever “director
of the treating facility” appears in relation to the completion of reports for the court.
Petition for release of acquittee
Senate Bill 1134

Amend Code of Virginia §19.2-182.6B to clarify that the court is only
required to order the DMHMRSAS “Commissioner to appoint two persons…to assess and report
on the acquittee’s need for inpatient hospitalization” when the petition for release
has been submitted by the acquittee (and not when submitted by the Commissioner).
